    Regarding the issue of “the bridge” providing access into and out of the Mill Island community of Wormans Mill, I have to ask this question:

    When the development of Mill Island was being considered by the local government authorities, what guidance was ignored by those responsible for providing permits for this project? Surely, someone at that time must have looked at the idea of one single access road and thought, what would happen if the one road was either temporarily or completely unavailable to this community. Yet, the public servants responsible for permitting this project decided that this eventuality would not happen. So far, they have been correct, but that does not protect the residents of Mill Island from the possibility of denied access in the future.

    What would be the impact of a temporary closure of this access road? Days, weeks or months would deprive the residents access to emergency services coming into and first responders needing to get out of Mill Island. Police, fire, ambulance, utility crews would not be able to provide emergency services. The resulting loss of life and/or property would be indemnified by who? What would be the cost of litigation to the city in the event of an anticipated catastrophe?

    Surely, the responsibility of city, county and/or state officials would be to provide guidance in the public interest to ensure that public safety was provided to this and every other community under their jurisdiction.

    What procedures are in place to provide emergency access to Mill Island residents in the event of the loss of access to this one bridge? Are there adequate resources available to be timely deployed in the event of such a possibility? If the answer is, “not much, sorry,” that is not consistent with the responsibility that public servants are required to plan for in the case of a single point of failure that could easily be anticipated and mitigated with proper planning at the time of initial review of the plan to build this community.

    What plans are available for the possibility of loss of vehicular access to Mill Island in the event of loss of the lone bridge currently in use and how long would it take to erect an emergency access route in case of emergency?

    Ignoring the problem does not make it go away. Please help. Thank you.

    I am new resident of Worman's Mill writing to ask that you accept your Department of Public Works recommendation that the City of Frederick assume ownership of the emergency access bridge over Tuscarora Creek. When we purchased our home one year ago we had no idea that we were assuming liability for the bridge. Nothing about this bridge liability was in our deed or disclosures. We only learned about it when we were notified by our HOA that we would be individually billed for its repairs. Of even greater concern to us is our personal liability should someone injure themselves on the bridge. Our property is neither contiguous to nor even near the bridge. Those Frederick residents who use the Mill Island bridge do not all live on Mill Island, nor even in Worman's Mill. I understand that you are taking this under consideration today. I will attend the meeting, but can only stay until 2 o'clock. I wanted to be sure you had the opportunity to hear our concern. We strongly urge you to accept the recommendation of your Department of Public Works staff to have the city assume ownership of this emergency access bridge.     a resolution or other document releasing the “Lots” from the obligation in the Road

    As a resident of Mill Island, I fully support the recommendation of the DPW to release all Mill Island homeowners of the obligations detailed in the Road Declaration, and for the City to assume ownership, liability, and maintenance responsibilities of the emergency access road and bridge. Should the Council not respond in the affirmative to this recommendation, there are a host of unanswered questions that the City will need to respond to in order to determine whether the City can enforce the obligations as cited in the Road Declaration. Given limited time and space, these questions are well documented in numerous emails dating back as far as early 2024 with the Mayor, Board or Alderman, and Frederick City Council, all of which are a matter of public record. All of my questions and requests for a meeting have gone unanswered to this day. Additionally, there are numerous emails and other communications directly with Councilwoman Nash, who unsuccessfully attempted to get answers on my behalf. Chief among my documented concerns, the Road Declaration makes clear that “the city requires the lots be subject to the obligation to contribute pro rata….” I assert that this amounts to a hidden tax, but more likely a lien on my property, despite that fact that my title guarantees no liens. While not an attorney, I assert that the Road Declaration is not the proper legal instrument for the City to levy either a tax or a lien on a homeowner. While open to being proven wrong, the City has failed to provide any legal analysis on this matter despite repeated requests. Further, the bridge was built in a known flood zone. Just by observation, the flooding exceeds the specifications established when the bridge first was constructed. Replacing the bridge is a homeowner responsibility per the Road Declaration. Although told that there is no reason to believe the bridge will need to be replaced, there has been no updated engineering analysis that I am aware of to support this assertion, again, despite repeated requests. The Road Declaration was the product of an agreement between Wormald Builders and Frederick City, but unsuspecting homeowners were saddled with unbounded costs and liability for what amounts to a public walking and bike path used by Woman’s Mill (not just Mill Island) residents and residents of surrounding neighborhoods. This agreement allowed Wormald to build more houses, and the City to collect more taxes. It’s time to remedy this injustice.

    As a resident of Mill Island, I emphatically endorse the DPW’s staff recommendation to release the “Lots” from the obligation detailed in the Road Declaration and for the City to assume ownership, liability, and maintenance responsibilities of the emergency access road and bridge crossing Tuscarora Creek.

    When we bought our house on Mill Island, we were never informed of the obligation (and/or related costs) associated with the maintenance, repair, and replacement of the emergency road and bridge. Let me be crystal clear on this, we were not told of, nor presented with any related documents, especially the Road Declaration. We definitely did not sign or initial any acknowledgement or document related to any such obligation. Any statement to the contrary is inaccurate.

    The law firm of Whiteford, Taylor & Preston L.L.P. which represents the Worman’s Mill Community Conservancy, Inc. has communicated with the City Attorney Rachael, Esq. Based upon the Road Declaration, this law firm noted that all of the individual lot owners are collectively responsible for the maintenance, repair, and replacement of this road and bridge. Additionally, they noted that the maintenance, repair, and replacement of this road and bridge is neither a function nor an obligation of the Worman’s Mill Community Conservancy (HOA). Because of that, the HOA will not assess nor collect any funds related to the road and bridge from the lot owners, nor will it enter into any further cleaning, maintenance, or repair contracts related to the road and bridge. Therefore, the current situation is that the City will need to coordinate with all 657 lots owners in order to effectuate any maintenance, repair, or replacement of the road or bridge. This is an untenable situation. There are hundreds of Mill Island residents that expect that their elected officials on the City Council will do the right thing by releasing them from this obligation.

    With the establishment of the City of Frederick Worman’s Mill Park, the vast majority of the emergency road, along with the bridge, has been transferred to the City. Since the City now owns it (mostly), the City should bear the responsibilities for it, as it already does for similar roads throughout the City of Frederick.

Where else in the City are its already tax paying residents required to additionally, privately repair, replace, and insure a bridge and a road designed and constructed only for public emergency use? Only the City (with it's existing DPW) is equipped to effectively own and operate something like this.
