My name is Nancy Denlinger, and I am a resident of Wormans Mill community in Frederick Maryland. I have lived in my home for over 20 years. I am writing in response to the issue you will be discussing on our emergency access bridge located on “the island“. When we bought our home all these so many years ago, we were uninformed about our responsibility for care of this bridge, which is predominantly used as a walking bridge on a trail. We were also unaware that this bridge came along with a lien against our homes. Residents of mill island, which are predominantly, senior residence, were informed of our responsibility just about two years ago. This issue came out of the blue to all of us. We are already living on very small lots and responsible to pay both county and city taxes, additionally, county and city water, leaving us with a heavy tax burden. Most of our services and benefits come from the county, and very little from the city. I am asking that you reconsider our responsibility for the “emergency access bridge“. Until two years ago, I never knew this even existed! I dare say emergency equipment would have a great deal of difficulty even getting to this site. Please consider the fact that most of us are seniors on limited income, and we are asking your support and removing this burden from us. Thanking you in advance for your consideration, respectfully, NancyDenlinger

As a Concerned Resident of the Mill Island part of Worman’s Mill, I write to you in
full support of the “Comments of Concerned Residents of Mill Island, Worman’s

Public Works to release all of the “Lots” on Mill Island from the obligation detailed in
the Road Declaration and for the City to assume ownership, liability, and maintenance
responsibilities of the emergency access road and bridge crossing Tuscarora Creek.
And I further urge Council Members to approve the recommendation of DPW to draft
a resolution or other document releasing the “Lots” from the obligation in the Road

Thank you in advance for your much needed vote in favor of the relief to Mill Island residents requested by DPW. My reasons are: 1. said road/bridge is a structure within the newly formed City of Frederick Worman's Mill Park. No other city resident is required to maintain or be exposed to the liability of such assigned "ownership"; all legal opinion has noted that the current declaration and obligations are "unprecedented";3. the structure has never been used in 25 years for any other purpose than as a recreational walkway which floods regularly. Its function has been superseded by the Class A two-lane main access bridge which is some 60' above flood plain;3. on grounds of plausibility and probability as the coincident occurrence of any conceived emergency or fire with some contrived failure or obstruction of the existing two-lane highway bridge is so unlikely as to be totally implausible. I think you would agree that such a hypothetical necessity for additional "emergency access" or for funding any City infrastructure would ordinarily not meet with common sense standards for budgetary approval; 4. the current "emergency access road / bridge despite claims of soundness has never been tested with the actual passage of fire vehicles. The 12' width barely allows passage and the bridge must be accessed via a condominium parking lot with a winding narrow entry which has never been tested by passage of an actual fire truck. This effective "funnel" would severely limit the rate of passage of multiple responders, especially at night as it is unlighted. The only house fire on Mill Island burned to a total loss in about 45" despite a wide-open two-lane bridge which allowed 13 fire vehicles rapid access; 5.the current declaration represents a lien and encumbrance that is subject to legal challenge.
